These Terms of Service (“Terms”) are an agreement between you and Graham Vonnegut, who operates SafeSound (“SafeSound,” “we,” “us,” or “our”). They govern your use of the SafeSound mobile application and its content and features (together, the “Service”).
By downloading, accessing, or using SafeSound, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

1. The Service
SafeSound is an audio relaxation app. It offers ambient sounds, meditations, spatial (“8D”) versions of catalog sounds, offline downloads, and the 8D-ifier, which applies a spatial effect to audio or video files you choose from your device. Content and features may change, be added, or be removed over time.
The Service is for your personal, non-commercial use.
2. Wellness and listening safety
SafeSound is for relaxation and general wellbeing. It is not a medical device and does not provide medical advice, diagnosis, or treatment. It is not a substitute for professional care. If you have a medical or mental health condition, talk to a qualified professional.
Listen at a comfortable volume. Prolonged listening at high volume, especially with headphones, can damage your hearing. Do not use SafeSound, and especially sleep, meditation, or spatial audio, while driving, operating machinery, or doing anything else that needs your full attention.
3. Eligibility and your account
You must be at least 13 years old (or the minimum age required in your country) to use SafeSound. If you are under the age of majority where you live, you may use SafeSound only with the involvement of a parent or guardian who agrees to these Terms.
SafeSound does not ask for an email or password. When you first open the app, we create an anonymous account for you so your name, goal, favorites, and subscription status work across sessions. We use the wellness goal you choose only to personalize SafeSound. We do not share it with analytics providers or advertisers (see our Privacy Policy). You are responsible for activity on your device and account.
Deleting your account. You can delete your account at any time in Profile → Account → Delete Account. This permanently deletes your account data as described in our Privacy Policy. Deleting your account or the app does not cancel a subscription; cancel that in your App Store settings.
Inactive accounts. If you have a free account and do not open SafeSound for 6 months, we will automatically and permanently delete your account and its data (including your profile and favorites), as described in our Privacy Policy. If you had SafeSound Pro, the 6 months are counted from the later of your last app open and the end of your subscription. We will not delete an account while it has an active SafeSound Pro subscription or free trial. If you have allowed notifications, the app will warn you about 4 months and 5 months after you last opened it and about 7 days before deletion. These warnings depend on notifications being on and the app still being installed, and not receiving one does not prevent deletion. Opening SafeSound before the deletion date keeps your account. Deleted accounts cannot be recovered. You can restore an active subscription to a new account at any time (see Section 6).
4. SafeSound Pro subscriptions
Without a subscription you can browse the catalog. A paid subscription (“SafeSound Pro”) is required to play sounds, meditations, and 8D audio, to download audio for offline listening, and to use the 8D-ifier. Some features may offer a short free preview.
SafeSound Pro is sold as an auto-renewing subscription through in-app purchase on the Apple App Store (and Google Play where available). The available plans, their length, price, and any free trial are shown on the purchase screen before you buy, and prices may vary by country.
- Payment is charged to your Apple ID (or store account) when you confirm the purchase, or when any free trial ends.
- Automatic renewal. Your subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.
- Cancelling. You can manage or cancel your subscription in your device settings (on iOS, Settings → your name → Subscriptions) or from Profile → Manage Subscription in the app. Cancelling stops future renewals; you keep SafeSound Pro until the end of the period you have paid for.
- Price changes. If a subscription price changes, Apple (or Google) will notify you and, where required, ask for your consent before the new price applies.
- Refunds. Purchases are billed by Apple (or Google), so we cannot issue refunds ourselves. To request a refund for an App Store purchase, visit reportaproblem.apple.com. For Google Play, request a refund through Google Play. Refunds are subject to their policies.
5. Free trials
If a free trial is offered, the purchase screen shows its length and the price you will be charged when it ends. Apple (or Google) decides who is eligible, and each store account can usually use a trial only once. Unless you cancel at least 24 hours before the trial ends, your subscription starts automatically and you will be charged. If you buy a subscription during a free trial, any unused part of the trial ends where the store’s rules say so.
6. Restoring purchases
If you reinstall SafeSound, get a new device, or your account was deleted, use Profile → Restore Purchases (or Restore Purchases on the subscription screen) while signed in to the same store account to re-link an active SafeSound Pro subscription. Purchases are verified through Apple (or Google) and our subscription partner, RevenueCat.
7. Fair use limits
To keep the Service reliable and affordable for everyone, we limit how much audio each subscription can stream or download across all accounts and devices it is used on (currently 10 GB of new audio per rolling 30 days), and how much can be stored for offline listening on a device (currently 10 GB). The 8D-ifier accepts files up to 50 MB and 15 minutes long. We may adjust these limits, and we may temporarily limit access if we detect unusual or abusive activity.
8. Files you use in the 8D-ifier
The 8D-ifier processes files you choose on your device. We do not upload them to our servers, and we do not claim any ownership of your files or the results.
You are responsible for the files you use and for what you do with the results. Only use files you own or have the right to use, and do not use the 8D-ifier to copy, share, or publicly distribute anyone else’s music or recordings without permission. The spatial versions you create are for your personal use unless you hold the rights needed to share them.
9. Acceptable use
You agree not to:
- Copy, record, download outside the app’s features, redistribute, sell, publicly perform, or broadcast SafeSound content
- Share, resell, or transfer access to SafeSound Pro, or get around subscription checks, usage limits, or other protections
- Reverse engineer, decompile, or modify the app, except where the law allows it despite this restriction
- Attempt to access our servers, other users’ data, or parts of the Service you are not authorized to use, or interfere with how the Service works
- Scrape the catalog or use automated means to access the Service
- Use SafeSound in any way that breaks the law or these Terms
10. Our content and intellectual property
SafeSound, including its name, logo, app, software, design, and catalog audio, artwork, and text, is owned by us or our licensors and is protected by intellectual property laws. Some audio is used under licenses from its creators; see Profile → Credits & Licenses in the app.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, and to stream and download catalog content within the app for your own personal, non-commercial use. Downloaded content can only be played inside SafeSound and may stop being available if your subscription ends or content is removed. All rights not expressly granted are reserved.
If you send us feedback or suggestions, we may use them without any obligation to you.
11. Third-party services
SafeSound relies on third-party services, including Apple and Google for purchases, RevenueCat for subscription management, Supabase for hosting, and PostHog for analytics. Your use of those platforms may also be governed by their own terms. We are not responsible for third-party services or websites you choose to use outside SafeSound.
12. Suspension and termination
You may stop using SafeSound at any time and delete your account in the app. We may suspend or end your access to the Service if you seriously or repeatedly break these Terms, if required by law, or to protect the Service or other users. If we end your access without cause while you have an active subscription, we will tell you how to request a refund for the unused period where required by law. Sections that by their nature should survive termination (including 8 through 10 and 13 through 17) survive.
13. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted, error-free, or available offline at all times, or that any particular content will remain available, or that SafeSound will produce any particular result for you.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
14. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of, or inability to use, the Service. Our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid for SafeSound Pro in the 12 months before the claim, or (b) US $50.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, fraud, or your statutory rights as a consumer.
15. Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, files you use in the 8D-ifier, or your violation of these Terms or of anyone else’s rights.
16. Governing law and disputes
These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Service will be brought in the state or federal courts located in New York County or Kings County, New York, and you and we consent to their jurisdiction. If you are a consumer living in a country that gives you the right to bring claims in your local courts or under your local laws, nothing in these Terms takes that right away.

17. Changes to these Terms
We may update these Terms from time to time. We will change the “Last updated” date and, for material changes, give reasonable notice in the app when practical. Continued use of SafeSound after an update means you accept the revised Terms. If you do not agree, stop using SafeSound and cancel any subscription.
18. General
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms; we may transfer ours in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and us about SafeSound.
19. Apple App Store terms
If you downloaded SafeSound from the Apple App Store, the following also applies:
- Acknowledgement. These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for SafeSound and its content.
- Scope of license. Your license to use SafeSound is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that SafeSound may be accessed by other accounts associated with you through Family Sharing or volume purchasing where available.
- Maintenance and support. We are solely responsible for providing any maintenance and support for SafeSound. Apple has no obligation to do so.
- Warranty. If SafeSound fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation for SafeSound, and any other claims, losses, or costs caused by a failure to conform to a warranty are our responsibility, to the extent not disclaimed in these Terms.
- Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to SafeSound or your use of it, including product liability claims, claims that SafeSound fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
- Intellectual property. If a third party claims that SafeSound or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling, and discharging that claim.
- Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must comply with any applicable third-party terms (such as your wireless data agreement) when using SafeSound.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
Where these Terms conflict with Apple’s Licensed Application End User License Agreement, these Terms apply to the extent permitted.
